The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Revelganj P.S. Case No. 246 of 2017 instituted for the offences under Sections 302 and 201 of the Indian Penal Code.

Prosecution allegation, in short, is that the accused person thrown the child of the informant into river due to which he died.

The earlier bail application of the petitioner was

No.27166 of 2020(3) dt.01-12-2020 2/2 rejected vide Annexure-1 to the present application taking into account that there was a specific allegation against the petitioner that he had thrown the child in the river which led to his death. A report was called for from the Trial Court regarding the stage of the case. It has been reported that two prosecution witnesses have already been examined.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the nature of allegation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial at the earliest preferably within a period of nine months from the date of receipt/production of a copy of this order.
