ANJANA MISHRA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Bihpur (Jhandapur) P.S. Case No.521 of 2017 for allegedly having committed the offence under Section 386/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case is false and fabricated because it is highly improbable that the petitioner being unarmed can accost the informant, who is accompanied by his gunman, to demand extortion money. It is further submitted that the offence as alleged is not made out. However, on account of previous enmity, the petitioner has been roped in in connection with the

Having heard the submissions of the learned counsel for the petitioner and the learned counsel for the State and the material details of the prosecution story, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st, Naugachhia (Bhagalpur), in connection with Bihpur (Jhandapur) P.S.
