JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406,420,468 and 471/34 of the Indian Penal Code.

The prosecution case is that the informant purchased 46 decimals of land on persuasion of this petitioner from Sudist Sharma but the possession of the land was not given to the informant. Subsequently, the informant came to know that two kathas of purchased land was transferred to Ram Palav Das and his daughter Raj Mohani Devi.

It is submitted by the learned counsel for the petitioner that petitioner is witness to the sale deed and the identity of the

Patna High Court Cr.Misc. No.53525 of 2015 (2) dt.24-11-2015 2/2 vendor of the informant is not in dispute. It is further submitted that thrust of accusation is against Sudist Sharma. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Samastipur in connection with Samastipur Mufassil P.S. Case No.269 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
