2. This writ petition is filed against an order passed by the authorities of the BISCOMAUN, whereby the petitioner has been compulsorily retired.

3. Learned counsel for the BISCOMAUN as well as learned State counsel have submitted that the writ petition against the action of the BISCOMAUN is not

Patna High Court CWJC No.20705 of 2013(3) dt.16-12-2024 2/2 maintainable. The said issue has been settled by the Special Bench of this Court in the case of Organizer, Dehri C.D. & C.M. Union Limited v. State of Bihar reported in (2014) 1 PLJR 695.

4. Learned counsel for the petitioner has not disputed the proposition of law laid down by the Special Bench of this Court in the decision referred to hereinabove.

5. Under the circumstances, this writ petition is hereby disposed of with liberty granted to the petitioner to take recourse to remedy before the appropriate forum as may be permitted under the law.

6. This writ petition stands disposed off.
