Mr. Satyabir Bharti Mr. Alok Chandra (In CWJC No.17663 of 2015) For the Petitioner/s : Mr. Y. B. Giri, Sr. Advocate Mr. Arun Kumar For the Respondent/s : Ms. Archana Sinha AC to GP-25 For the BESB:
Mr. Satyabir Bharti Mr. Alok Chandra =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 02-08-2016 The original tabulation register, as directed by the Court, has been produced for perusal of the Court. The Court shared the position by permitting learned senior counsel for petitioners to peruse the tabulation register as well.
In both the cases, there is a clear endorsement of the fact that the results of both these petitioners were cancelled as far back as on 30.07.1993 on the orders of the erstwhile Chairman of the Examination Board.
If that be so, there cannot be any direction upon the Examination Board to issue a duplicate mark-sheet on the given facts.
The other arguments with regard to such cancellation are not required to be gone into in the present case. Both the writ applications are dismissed, accordingly. Petitioners have recourse in law on that aspect of the matter.
Patna High Court CWJC No.18230 of 2015 dt.02-08-2016 3/3 The original tabulation register has been returned to the counsel for the Examination Board.
