Mr.Md. Mushtaque Alam ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-01-2023 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

The petitioner apprehends his arrest for the offences alleged under Sections 364 of the Indian Penal Code registered in connection with Nasriganj P.S. Case No.208 of 2017. As per allegation, some unknown persons came by Scorpio and kidnapped the brother of the informant. Learned counsel for the petitioner has submitted that the petitioner is innocent and on similar footing co-accused persons have been granted regular bail.

On the other hand, learned APP has submitted that the case was registered in the year 2017. The petitioner remained

In view of the recent decision in the case of Prem Shankar Prasad vs. State of Bihar and Another (2021 SCC online SC 955), this application is not maintainable and the same is rejected.

Office shall ensure that all the defects are removed by the petitioners within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
