JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 21.08.2020, within four weeks of starting of Court proceeding in physical mode. This application has been filed for Modification of order dated 21.11.2019 passed in Cr. Misc. No. 73120 of 2019. Learned counsel appearing on behalf of the petitioners submits that petitioners were granted Anticipatory Bail on 21.11.2019 passed in Cr. Misc. No. 73120 of 2019 with a direction to surrender before the court below within a period of four weeks, on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.22612 of 2020(2) dt.03-02-2021 2/2 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Hussainganj (M.H. Nagar) P.S. Case No. 27 of 2019, but due to some unavoidable circumstances, petitioners could not surrender before the court below within the stipulated time.

In such view of the matter, the time to surrender of the petitioners as per order dated 21.11.2019 passed in Cr. Misc. No. 73120 of 2019 is further extended by four weeks from today in connection with Hussainganj (M.H. Nagar) P.S. Case No. 27 of 2019, pending in the court of Chief Judicial Magistrate, Siwan.

Accordingly, the modification application is allowed and the order dated 21.11.2019 passed in Cr. Misc. No. 73120 of 2019 is modified to the above extent.

Accordingly, the application filed on behalf of petitioners stands disposed of.
