Petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 428 of 2020 registered for the offence under Section 414 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is that Police intercepted a TATA 407 mini truck and recovered a total quantity of 495 liters of illicit foreign liquor from the same.
Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and he has falsely been implicated in this case merely on the basis of the fact that at the time of seizure of the illicit liquor the said mini truck was being driven by him. He further submits that the petitioner is the driver and was not aware about illicit liquor being kept therein by its owner. He next submits that petitioner is in custody since 19-12-2020 and charge sheet has already been submitted. Regard being had to the submissions made by the
Patna High Court CR. MISC. No.33573 of 2021(2) dt.21-12-2021 2/2 parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 19/12/2020 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Excise, Bhagalpur in connection with Jagdishpur P.S. Case No. 428 of 2020.
