The petitioner has filed this petition for modification of the order dated 02.02.2018 passed in Cr. Misc. No. 5145 of 2018 for extending the period of surrender of petitioner before the court below.

The learned counsel for the petitioner submits that petitioner was granted anticipatory bail vide order dated 02.02.2018 passed in Cr. Misc. No. 5145 of 2018 but he could not surrender in the court below in time as the petitioner was living outside his village to earn the livelihood and proper information was not given to the petitioner.

Taking into consideration the facts aforesaid, this modification is allowed and the order dated 02.02.2018 passed in

Patna High Court Cr.Misc. No.17065 of 2018 (2) dt.02-05-2018 2/2 Cr. Misc. No. 5145 of 2018 is modified to the extent that period of surrender of petitioner before the learned court below, i.e., the learned Chief Judicial Magistrate, Begusarai in Barauni P.S. case No. 376 of 2017 is extended for further three weeks from today.
