2. At the very outset, learned counsel for the petitioner submits that the present writ application has been filed against the order dated 09.02.2026 passed by the Land Reforms Deputy Collector, Bagaha, West Champaran, in Land Dispute Resolution Case No.124 of 2025-26 directly before this Court

Patna High Court CWJC No.5852 of 2026(2) dt.05-05-2026 2/2 and the appropriate remedy would lie before the Divisional Commissioner by way of appeal against the said impugned order.

3. In the aforesaid background, learned counsel seeks permission to withdraw the same with liberty to move before the appropriate forum.

4. Accordingly, this writ application is dismissed as withdrawn with liberty to avail the remedy before the appropriate forum.

5. If the petitioner avails the remedy before the appropriate forum, the time consumed in this Court during the pendency of this writ application shall be taken into consideration while considering limitation, if any. (Khatim Reza, J) J. Alam/- U
