In this case, the petitioner is challenging the order of appeal passed by the District Magistrate, Kaimur at Bhabhua dated 2.5.2013 passed in Misc. Appeal (Angan Bari Sevika) Case No. 16 of 2013/14 by which the petitioner has been dismissed from service by one line order.

The petitioner was working as Anganwari Sahaika in the Center No.28, Center-Sahpur, Panchayat Madurana, Block Chainpur, Kaimur at Bhabua. On 3.8.2011, the District Programme Officer randomly visited at the center where the petitioner was working and it was found that the petitioner was not running the center properly, whereafter, she was given

Patna High Court CWJC No.14675 of 2013(2) dt.20-06-2019 2/2 notice and after considering the show-cause, the engagement of the petitioner has been dispensed with by the D.P.O. vide order dated 28.9.2011 (Annexure-3) which she challenged in appeal and the same was dismissed by one line order. The order passed by the appellate authority is supposed to be a reasoned order considering all the facts and grounds taken in appeal but, instead of doing so, he has chosen to pass an order in such a cryptic manner that cannot be approved by this Court.

Accordingly, the order dated 2.5.2013 passed in Misc. Appeal (Angan Bari Sevika) Case No. 16 of 2013-14 is set aside and the matter is remanded back to the District Magistrate, Kaimur at Bhabhua who will pass a reasoned order in accordance with law.

All the process should be completed within a period of three months from the date of receipt/production of a copy of this order.

In the result, this writ application stands allowed to the extent indicated above.
