JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2017 The present application has been filed by the petitioner for modification of the order dated 10.04.2015 passed in Cr.Misc. no. 43370 of 2014.

It is submitted on behalf of petitioner that earlier anticipatory bail was granted to the petitioner with condition that he makes payment of Rs. 5 lacs within a period of two months but he could not deposit the same as his son-in-law became ill and he was cancer patient but now, he is ready to deposit the aforesaid amount as and when directed by this Court.

Heard learned A.P.P. and learned counsel for complainant also.

Having heard both sides. There is violation of the direction of this Court but considering the grounds taken by the

Patna High Court Cr.Misc. No.46093 of 2016 (3) dt.20-01-2017 2/2 petitioner as well as the fact that petitioner is ready to deposit demand draft of Rs. 5 lacs in the Court as and when directed by this Court, let the petitioner surrender before the court below with demand draft of Rs. 5 lacs within a period of one month and the learned court below after submission of the demand draft will release the petitioner to the satisfaction of the court below. No further modification is required and hence, this modification application is disposed of.
