In this case, the petitioners are seeking anticipatory bail in connection with Harsidhi P.S. Case No.314 of 2016, registered for the offence punishable under Section 420 of the Indian Penal Code and under Section 138 of the N.I. Act. Allegation has been made that the husband of the petitioner has given a cheque of Rs.4,00,000/- to the informant, but the said cheque was bounced due to insufficient balance. In this case, the petitioners are the wife and brother of that person, are not in any way concerned with issuance of the cheque, but have been made accused on account of the fact that
Patna High Court Cr.Misc. No.40649 of 2017 (2) dt.19-09-2017 2/2 both of them went to the house of the informant and entered into altercation with him.
Looking to the facts and circumstances of the case, let the petitioners, namely, Pushpa Devi and Munilal Sah, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari (East Champaran), in connection with Harsidhi P.S. Case No. 314 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Shivaji Pandey, J) pawan/- U T
