JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-05-2019 Earlier prayer for bail of the petitioner was rejected twice vide order dated 12.09.2018 passed in Cr. Misc. No. 37892 of 2018 and vide order dated 28.11.2018 passed in Cr. Misc. No. 67421 of 2018.

Allegation against the petitioner is of committing rape upon the informant and also taking naked photograph in mobile and put it on internet.

Submission of learned counsel for the petitioner is that good sense has been developed between the parties and the informant is agree to marry with the petitioner. Heard learned A.P.P. also.

Having heard both sides, considering the nature of

Patna High Court CR. MISC. No.26620 of 2019(2) dt.01-05-2019 2/2 allegation, I am not inclined to grant bail to the petitioner, however, once the evidence of the victim informant is taken, the petitioner is at liberty to move before the court below itself for grant of bail, which will be considered on the basis of above statement and materials available on record.

Accordingly, this application is dismissed.
