Petitioner seeks full salary for the period of suspension which was revoked vide memo no.1365(4) dated 29.07.2011 (Annexure-2 to the writ petition). It is the case of the petitioner that during the period of his service or after his superannuation no departmental proceeding was initiated against him. He further submits that he had made a detailed representation on 12.09.2011 after his superannuation before the Director-in-Chief, Health Department, Government of Bihar, Patna, vide Annexure-3 to the writ petition.
Patna High Court CWJC No.20811 of 2011(3) dt.09-12-2021 2/2 Considering the limited submissions made on behalf of the petitioner and pleadings made in the writ petition, the petitioner may file a detail representation before the Directorin-Chief, Health Services, Government of Bihar, Patna for payment of full salary for the aforesaid period. If such representation is made within a period of three weeks along with the order of this Court it is expected that reasoned and speaking order be passed after giving an opportunity of hearing to the petitioner.
With the aforesaid direction instant writ application is disposed of.
