Petitioner apprehends arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

On the secret information, a raid was conducted and a stolen motorcycle was recovered from the house of one Sunny Kumar.

Learned counsel appearing for the petitioner submits that name of the petitioner transpired on the basis of confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got clean antecedent.

No.26862 of 2023(2) dt.07-07-2023 2/2 Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda in connection with Sohsarai P. S. Case No. 11 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
