JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 02-03-2017 It is submitted by the learned counsel for the petitioner that the petitioner was appointed as Ayurvedic doctor on 09.08.1972 and retired on 30.01.2003 as Medical Officer from Nagar Panchayat, Mahnar. He was allowed to receive payment of pension vide letter no.122 dated 15.06.2005 from October, 2003, but the pension was not paid to him. Thus, he was compelled to file this writ application.
2. It is submitted that during the pendency of the writ application the respondents have paid pension to the petitioner upto
Patna High Court CWJC No.6927 of 2014 dt.02-03-2017 2/2 July, 2016, but thereafter the pension amount is not being paid to him.
3. Considering the submissions made above, the writ application is disposed of with a direction to the petitioner to file a representation before the Executive Officer, Nagar Parishad, Mahnar within a period four weeks from today. In case such a representation is filed the Executive Officer, Nagar Parishad, Mahnar shall examine the same and if pensionary benefits are found to be admissible, the petitioner should be paid arrears of pension and regular pension without any delay preferably within a period of two months from the date of filing of such representation.
