JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 This is an application for grant of anticipatory bail in connection with Belhar P.S. Case No. 37 of 2018, disclosing offences under Sections 366 A, 120B, 504, 506, 34 of IPC. Allegation against the petitioner as per the F.I.R. is of kidnapping the minor daughter of the informant by the son of the petitioners and it is stated that when they went to the house of the petitioners to enquire about the same, they threatened and misbehaved with the informant.

Submission of the learned counsel for the petitioners is that allegation of kidnapping is against the son of petitioner no.1 and not against these petitioners.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that the girl is still trace-less.

No.25102 of 2019(4) dt.17-07-2019 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, so far as, petitioner no.2 is concerned, being a lady, in the event of her arrest or surrender before the court below, she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. III, Banka, in connection with Belhar P.S. Case No. 37 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. So far as, petitioner no.1 is concerned, I am not inclined to grant privilege of anticipatory bail to the petitioner no.1.
