2. Petitioner seeks bail in a case registered for offence under Sections 406, 420, 408, 409, 34 of the Indian Penal Code.

3. As per F.I.R., the allegation against petitioner is that he alongwith other co-accused persons, who were employees of the B.D.Sinha Janta College, Akauna, misappropriated Rs. 48,67,500/-, which was collected as enrollment fees from the students, but the accused persons did not deposit the said amount in the bank account of the college and kept it with themselves.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely because he is employee of the said college. Petitioner has no concern with the collected money of the college. As a matter of fact, it was the informant and others, who embezzled the fund of the college, for which, the on 23.10.2019, informant himself was removed by the inquiry committee and later, on 17.08.2020, he was terminated from the post of Principal, but again on 11.03.2022, he was appointed on the same post. It is the

Patna High Court CR. MISC. No.29822 of 2025(3) dt.22-08-2025 2/2 informant, who defalcated Rs. 18 lakhs of the college, as such; Goh P.S. Case No. 149 of 2020 under Section 409 of the I.P.C. was lodged against him. Learned counsel further submits that co-accused Sudhir Kumar Singh has been granted bail by this Court, vide order dated 09.08.2024 passed in Cr.Misc. No. 29482 of 2024. Petitioner has got clean antecedent and is in custody since 17.2.2025. Chargesheet has been submitted.

5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Daudnagar (Aurangabad ), Bihar in Goh Police Station Case No. 303/2022.
