2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 80(2), 108, 85 and 3(5) of B.N.S. and charge has been framed under Section 108 of B.N.S.
3. The case of the prosecution, in short, is that the daughter of the informant was married to this petitioner six years ago. After some time of marriage, the daughter of the informant was subjected to cruelty on account of non-fulfillment of dowry demand. It is further alleged that on 09.06.2025, the husband of the deceased called on the mobile number of the informant and demanded dowry and also threatened to oust his daughter from house. 4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that from perusal of the F.I.R. itself it is clear that there is no allegation of any assault by the in-laws or the petitioner. The dead body of the deceased was recovered from a well with her two infants. It has further been submitted that after investigation, police has submitted charge-sheet under Section 108 of B.N.S. and learned trial Court has also framed charge under Sections 108 and 3(5) of B.N.S. It has further been submitted that actually it is not a case under Section 80 of B.N.S. rather the deceased has committed suicide with her two infants. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 04.07.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail
