SMT. NIRMALA KUMARI ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-02-2018 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Bihta P.S. Case No. 657 of 2017 registered for the offence punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The allegation is regarding one Raju Kumar having apprehended the daughter of the informant and it is said that the petitioners herein and other co-accused persons had aided the said Raju Kumar.

The learned counsel for the petitioners submits that the petitioner no. 1 is the father of the said Raju Kumar and the petitioner no. 2 is his sister and they have been falsely roped in the present case. It is submitted that the petitioners have no

Nonetheless, it is submitted that the said Raju Kumar has solemnised marriage witht the informant's girl in a temple and they are living as husband and wife. The petitioners are stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioners herein to the privilege of anticipatory bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Bihta P.S. Case No. 657 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
