1. Heard the parties.

2. The petitioner apprehends her arrest in connection with Siwan Sadar P.S. Case No. 696 of 2024 dated 05.11.2024 registered under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

3. As per the first information report the police party recovered a total quantity of 23.220 liters of illicit foreign liquor from a Hero Honda Splendor motorcycle bearing registration no. UP52BS3338 and apprehended one person namely, Taamil.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case and she has not committed any offence in the manner alleged. The name of the petitioner has transpired in this case only because she happens to be the registered owner of the motorcycle in question. It is

No.25698 of 2025(2) dt.07-05-2025 2/2 further submitted that the vehicle in question was borrowed by the relative of the petitioner for some urgent work and the petitioner was unaware about the fact the illicit liquor was being carried on her motorcycle. The petitioner is a lady having no criminal antecedent.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that petitioner is lady having no criminal antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Siwan in connection with Siwan Sadar P.S. Case No. 696 / 2024 subject to the condition as laid down under Section 482 (2) of the B.N.S.S. (Anil Kumar Sinha, J) praful/- U T
