The petitioner apprehends his arrest in connection with Pipariya P.S. Case No. 22 of 2016, registered under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of Shrawan Kumar Sharma, F.I.R. was instituted, on 11.06.2016, under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act, regarding murder of his brother through firearm and also loot of his mobile, gold chain and cash of Rs.20,000/- against unknown but with ulterior motive, on
Patna High Court Cr.Misc. No.55020 of 2016 (4) dt.18-04-2017 12.06.2016, one Raju Kumar and Anita Devi, wife of the deceased, whose statement are detailed in paragraphs 13 and 18 of the case diary, claimed themselves to be an eye witnesses and disclosed the name of this petitioner having hand in the offence. Thereafter, informant also claimed to be an eye witness to the occurrence in his re-instatement as detailed in paragraph 28 of the case diary. It is further submitted that the petitioner due to ulterior motive has been implicated after lodging the case by the informant and he has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Pipariya P.S. Case No. 22 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
