It has come at the instance of the petitioner. It is pointed out by the petitioner that although vide order dated 7.12.2015 a direction has been given to the District Magistrate, Patna to pass a fresh order, but it appears that facts of some other case have wrongly been typed in the present case. Learned counsel appearing for the State also agrees to that.

Accordingly, the third paragraph onwards of the order no.2 dated 07.12.2015 stands recalled and deleted and the same would be read as under :- "Having regard to the aforementioned facts and circumstances, let a decision be taken by the District Magistrate, Patna in the matter of the petitioner within a period of four weeks from the date of production of a copy of this order. While doing

Patna High Court CWJC No.18533 of 2015 (3) dt.09-02-2016 2/2 so, he would be obliged to consider the Family Heirloom Policy as well as the decision of this Court rendered in Manish Kumar Vs. The State of Bihar and Ors [2015 (4) PLJR 212]". The order dated 7.12.2015 stands modified to the extent as indicated above.
