JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-01-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Jokihat P.S. Case No. 249 of 2016 for the offences punishable under sections 120 B, 420, 467, 468 and 504/34 of the I.P.C.

It is submitted that this case has been lodged on the basis of the complaint petition with the allegation that the Branch Manager 'Jaiswal' was demanding bribe of Rs. 50,000/- and earlier he has also taken bribe to sanction the loan and when the informant refused then the Branch Manager 'Jaiswal', the petitioner and other unknown assaulted the complainant/informant.

Patna High Court Cr.Misc. No.54099 of 2016 (3) dt.18-01-2017 2/3 Submission is of false implication and that during investigation it has come that the informant was not repaying the loan and was again trying to take loan resulting there was some hot discussion between the Manager and the informant and thereafter the informant went away, vide paragraphs- 6, 7 and 8 of the case diary, no such occurrence has taken place as alleged and the petitioner was got implicated falsely only with a view to colour the case and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. submits that the petitioner is named in the FIR.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. S.D.J.M. Araria in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
