The petitioner apprehends his arrest in connection with Bhadwar P.S. Case No. 10 of 2016 registered under Sections 341, 323, 325, 307, 504 and 34 of the I.P.C. pending in the Court of J.M., 1st Class, Sherghatti, Gaya.

Submission is that petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against him. Further submission is that petitioner has no criminal antecedent.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner by contending that there is specific allegation of assault on the head of the

Patna High Court Cr.Misc. No.37068 of 2017 (3) dt.15-09-2017 2/2 informant with intention to kill him.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer of the petitioner is rejected.
