08-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Supplementary Gogari P.S. Case No. 161 of 2016 (G.R. No. 2166A of 2016), registered for the offence under Section 307 / 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R., the petitioner is alleged to have fired from his pistol upon the informant, as a result of which, the informant sustained burn injury in his head, hair and nose by gun powder.

It is submitted on behalf of petitioner that the nature of injury has been found to be simple by the doctor, as per injury report (Annexure - 2). Petitioner is in custody since 23.09.2020. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.35213 of 2021(2) dt.08-12-2021 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, learned Judicial Magistrate, Khagaria / concerned court in connection with Supplementary Gogari P.S. Case No. 161 of 2016.
