The petitioner is apprehending her arrest in connection with Madhubani Town P.S. Case No. 137 of 2015, G.R. No. 845 of 2015 for the offences instituted under Sections 189, 203, 209, 327, 353, 387 and 506 of the IPC.
The prosecution story, in brief, is that the informant, Atulveer Singh had received two messages from Mobile No.8294750575 to his Mobile No.9470258426 twice in the morning at 8.25 and 8.34 P.M. in which the petitioner had sent the message that he is speaking Mr. Justice B. N. Sinha Hon'ble High Court Patna that a case is pending in the court of the informant
Patna High Court Cr.Misc. No.54612 of 2015 (3) dt.09-03-2016 2/3 regarding Abhiram Yadav and he has declared juvenile but he is not being sent to remand home and police has falsely implicated him in this case and also said that family member of Abhiram Yadav was working at my house and one man shall meet you. Hence, FIR was lodged.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is a lady. From perusal of the case diary, it is evident that the husband of the petitioner was involved in the alleged offence but the petitioner has been made accused because of involvement of her husband. There is no sustentative piece of evidence against the petitioner to show her implication in the present case.
On behalf of the State it has been submitted that the petitioner is not named in the F.I.R. and her name has come in course of investigation.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Madhubani Town P.S. Case No. 137/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani, subject to the
Patna High Court Cr.Misc. No.54612 of 2015 (3) dt.09-03-2016 3/3 conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
