JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Samastipur (Town) P.S. Case No.171 of 2016 for the offences registered under section 307 and other minor Sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioners are said to have assaulted the informant with iron rod and butt of the pistol and also snatched Rs.15,000/- and, accordingly, the present case was lodged under Section 307 and other minor Sections of the Indian Penal Code. In course of investigation, the I.O. collected the injury report which has been annexed with the case diary. The aforesaid injury report dated
Patna High Court Cr.Misc. No.37463 of 2016 (4) dt.18-11-2016 2/2 27.10.2016 issued by the Dr. R.C.S. Verma, M.O. Civil Hospital, Samastipur goes to show that the informant sustained four injuries said to be caused by hard and blunt substance but all the injuries were found simple in nature as the concerned doctor did not find any fracture or any burn injury. Petitioners do not have any criminal antecedent.
Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Samastipur (Town) P.S. Case no. 171 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
