Petitioner is aggrieved by preparation of merit list for appointment of Aganbari Sevika of Ward No.12.

Patna High Court CWJC No.7242 of 2020(2) dt.10-09-2020 2/2 Learned counsel for the petitioner submits that the petitioner is entitled to appointment as the majority of population of Ward No.12 is general category and the petitioner is only candidate belonging to general category. Manifold submissions have been advanced on behalf of the petitioner. Learned counsel for the State submits that the petitioner has remedy by way of appeal which is not disputed by the counsel for the petitioner.

Considering the aforesaid, the writ petition is disposed of with liberty to the petitioner to approach the appellate authority by way of filing appeal alongwith a copy of this order within a period of one month from today and on filing of such appeal, the appellate authority will decide the appeal on its own merit after condoning the delay, if any, at the earliest, preferably within a period of three months from the date of filing of such appeal.

Any selection, in the meanwhile, shall abide by final outcome of the appeal proposed to be filed by the petitioner. (Anil Kumar Upadhyay, J) Ravi/- U
