Patna High Court CWJC No.6553 of 2023 dt.21-09-2023 2/2 petitioner submits that petitioner had retired from the post of teacher and is worried about the entitlement of the family pension after his death. It is next submitted that petitioner has solemnized marriage with Mithlesh Devi (second wife) with the consent of the first wife namely, Mauli Devi before being appointed on the post of teacher on 12.01.1974. He further submits that the first wife of the petitioner is legally wedded wife and she should be paid family pension after the death of the petitioner.

3. The writ petition is pre-mature as the petitioner is still alive and he is getting pension.

4. Accordingly, the present writ petition stands disposed of.
