JUSTICE ARUN KUMAR JHA ORAL ORDER 06-05-2025 Learned counsel for the petitioner submits that inadvertently in paragraph 9 of the petition, the date of custody of the petitioner has been mentioned as 06.12.2024 but the same is 04.08.2024 and seeks permission to correct the same in course of the day.
2. Permission is accorded.
3. Learned counsel for the petitioner is directed to make the aforementioned correction in course of the day.
4. Heard learned counsel for the petitioner and learned A.P.P. for the State.
5. In the present case, the petitioner seeks bail in connection with Wazirganj P.S. Case No. 309 of 2022, registered for the offences under Sections 379, 411, 413, 414, 34 of the Indian Penal Code.

6. As per the prosecution case, police apprehended coaccused Prince Kumar in connection with theft of motorcycle and the co-accused disclosed the name of this petitioner and other co-accused persons who were his associates in stealing motorcycles. At the instance of the co-accused, recovery of a number of motorcycles were made.
7. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and have been falsely implicated in this case. Nothing incriminating has been recovered from person or possession of this petitioner and he is not involved in dealing of the stolen motorcycle and except for confessional statement of the co-accused there is no material to show the involvement of the petitioner in the offences as alleged. The petitioner is in custody since 04.08.2024 and he has one criminal antecedent.
8. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.
9. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the lack of substantive material against the petitioner to show his involvement and further considering his period of custody and submission of charge sheet, the petitioner is directed to be

No.27112 of 2025(2) dt.06-05-2025 3/3 released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Gaya/concerned court, in connection with Wazirganj P.S. Case No. 309 of 2022, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
