JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Aurangabad (Town) P.S. Case No. 365 of 2011 registered under Sections 420, 467, 468, 406 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that, in fact, petitioner was the employee in O.C.P.L. Company and his duty was to maintain the records properly in routine manner, as such, he had no concern about misappropriation of amount as alleged in the complaint petition, which is the basis of the F.I.R. It is further submitted that co-accused, Surendra Mishra, who was the Director of O.C.P.L. Company, has already been granted privilege of

Patna High Court Cr.Misc. No.2036 of 2017 (2) dt.30-01-2017 anticipatory bail by this Court vide order dated 19.02.2016 passed in Criminal Misc. No. 44031 of 2015. Further submission is that while petitioner is accused in 16 other cases in similar nature, but in 11 cases, he is on bail as detailed in paragraph 3 of the bail petition.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Aurangabad (Town) P.S. Case No. 365 of 2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
