JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-12-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bidupur P.S. Case No. 130 of 2017 registered for the offence punishable under sections 323, 386, 406, 420 of the Indian Penal Code, section 138 of the Negotiable Instruments Act and section 27 of the Arms Act.

After some argument, learned counsel appearing for the petitioner submits that petitioner is ready to pay the due amount of Rs. 10,20,000/- (Ten lac and twenty thousand) to the petitioner within a period of one year.

Learned counsel appearing for the informant submits that he has been cheated by this petitioner, however in case

Patna High Court Cr.Misc. No.52193 of 2017(4) dt.14-12-2017 2/2 petitioner is ready to pay the due amount of Rs. 10,20,000/- he has no objection.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 130 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C. with further condition that petitioner will make payment of the due amount of Rs. 10,20,000/- to the informant within a period of one year from today in ten equal installments. In case of failure of payment of even a single installment in the time, the Court below will be at liberty to take steps for cancellation of the bail bonds of the petitioner.
