JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2017 The appellant seeks pre arrest bail in connection with Revilganj P.S. Case No. 113 of 2017, registered for offences punishable under Sections 302/34 of the Indian Penal Code, Section 27 of the Arms Act and section 3(2)(V) of SC/ST Act. Allegation against the appellant and others is of firing on the brother of the informant causing his death. It has been submitted on behalf of the appellant that he has falsely been implicated in this case and another co-accused has been granted the privilege of regular bail by this Court vide order dated 13.09.2017 passed in Cr. Appeal (SJ) No. 2429 of 2017. Heard learned Special P.P. also.
Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not

APP (SJ) No.2458 of 2017 (4) dt.06-11-2017 2/2 inclined to grant the petitioner, the privilege of pre arrest bail rather this appeal is disposed of with direction to the appellant to surrender before the special court and make prayer for regular bail and if any such application is filed, the special court after considering the submission of learned counsel for the appellant that other co-accused has already been granted the privilege of regular bail, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
