Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends her arrest in connection with Arer P.S. Case No. 5 of 2020 registered for offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code. Allegedly, co-accused Rohit Kumar along with his associates named in the FIR kidnapped the daughter of the informant.
Learned counsel for the petitioner submitted that the present petitioner is mother of Rohit Kumar, against whom there
Patna High Court CR. MISC. No.33696 of 2021(2) dt.05-04-2022 2/2 was specific allegation of kidnapping. He has submitted further that the alleged victim did not support the case in her statement under Section 164 of the Cr.P.C., rather she has stated that she has solemnized marriage with Rohit Kumar, with her own sweet will.
Considering the above mentioned facts and circumstances, the petitioner above named, in the event of her arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Munsif-cum-Judicial Magistrate-1, Benipatti, Madhubani in connection with Arer P.S. Case No. 5 of 2020, subject to condition as laid down under Section 438 (2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
