====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-03-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Deo P.S. Case No. 78 of 2019 registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. The prosecution story in brief is that on 10.06.2019 a written petition was filed by the informant Priyanshi Kumari in which it was stated that on 30.05.2019 Nilesh Kumar, Vikash Kuamr, Arun Singh, Permila Devi and Anshu Kumari forcibly taken in a Bolero and they have forcibly taken in a Bolero and they have forcibly signed on marriage form at Vikramganj. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has

Patna High Court CR. MISC. No.27154 of 2020(4) dt.09-03-2021 2/2 falsely been implicated in the present case. Learned counsel for the petitioner further submits that that the informant itself had proposed Nikesh Kumar to get marry.

Learned counsel for the informant submits that the informant's signature was falsely obtained on the marriage form and on some plain paper. He further submits that the victim's marriage was already settled by his guardian and was scheduled to be held on 19.06.2019. The victim also supported the prosecution case under Section 164 of the Cr.P.C. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the above named petitioner in connection with Deo P.S. Case No.78 of 2019 pending in the court of learned Chief Judicial Magistrate, Aurangabad (Bihar) is hereby rejected.
