====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2024 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel for the informant.

2. Petitioners pray for bail in connection with Sanokhar P.S. Case No. 05 of 2024 registered under Sections 364, 302, 201, 120B and 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that these petitioners along with other co-accused persons kidnapped the sister of informant and killed her in order to grab her property.

4. Learned counsel for the petitioners submits that from bare perusal of the F.I.R., it is apparent that informant is

Patna High Court CR. MISC. No.29277 of 2024(5) dt.29-11-2024 2/2 not eye-witness to the occurrence. In the F.I.R., it is no where discussed as from whom he came to know about the incident. During course of investigation, no direct or indirect material has come to show complicity of the petitioners in the present case. Petitioners are in custody since 10.01.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur / concerned court in connection with Sankhar P.S. Case No. 05 of 2024.
