JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 406, 420, 34 of the Indian Penal Code, Section 8 of Bihar Illegal Extraction Act, 2003, Rules, 8, 4, 40 of Bihar Minor Mineral Concession Rules, 1972 and Rules 4, 21 of Mines & Minerals (Development & Regulation) Act, 1957.

The tractor of the petitioner was intercepted carries sand when the challan produced was not found genuine.

It is submitted by learned counsel for the petitioner that petitioner was not aware about the driver carrying sand. Moreover the petitioner was not there on the tractor when seizure was made though it was transported under valid permit.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.55737 of 2015 (2) dt.09-12-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IIIrd, Gaya in connection with Khizarsarai P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
