JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Gogri P.S. Case No. 173 of 2017 for the offences punishable under sections 341, 323, 379, 308 and 34 of the I.P.C.
In the FIR allegation against the petitioners is that they assaulted the informant with bottle of Pepsi on his head causing bleeding.
Submission is of false implication and that the informant has received only two simple injuries caused by hard and blunt substance which is superficial in nature, the petitioners
Patna High Court Cr.Misc. No.17288 of 2018 (2) dt.10-04-2018 2/2 have got no criminal antecedents and there is no chance of their absconding and as such they deserve sympathetic consideration. The learned A.P.P. fairly submits that the injuries caused to the informant are simple in nature. In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Brijesh Kumar J.M 1st Class, Khagaria in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
