The petitioner apprehends his arrest in Jandaha P.S. Case No. 76/2017, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that Manorma Devi was plucking mango from his orchard. The informant forbade her, then Suresh Singh, Amresh Singh and Bhola Singh came there. On the order of the petitioner, Suresh Singh and Amresh Singh assaulted the informant and his brother Abhay Kumar.

Learned counsel for the petitioner submits that Suresh Singh and Amresh Singh have already been granted regular bail. The petitioner is said to be order giver, but the allegation is ornamental and made only to implicate the petitioner.

No.43921 of 2017 (2) dt.22-09-2017 2/2 Considering the nature of allegation made against the petitioner and the fact that the occurrence took place due to petty dispute for plucking mango, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Vaishali at Hajipur in connection with Jandaha P.S. Case No.76/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
