JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 02-02-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Madhuban P. S. Case No.78 of 2016 registered under Section 304-B read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that though the first information report was instituted under Section 304-B read with 34 of the Indian Penal Code, in course of supervision, the case has been found true under Section 302 read with 34 and 201 of the Indian Penal Code. He
Patna High Court Cr.Misc. No.5544 of 2018 (2) dt.02-02-2018 2/3 submitted that so far as the petitioners are concerned, they are sister-in-laws (Gotani) and their status in the family is the same as that of the victim. He submitted that they were married more than 10 years ago. The husbands of petitioner nos. 1 and 2, namely, Amirilal Ram and Moti Lal Ram have already been granted bail by a Bench of this Court in Cr. Misc. No. 56724 of 2017 and the petitioner no. 3 is a widowed lady. He further contended that there is no material to connect the petitioners with the alleged offence save and except some vague and omnibus allegation which has been levelled mainly because they are related to the husband of the deceased.
On the other hand, learned Additional Public Prosecutor for the State submitted that the petitioners are named in the FIR and the offence alleged is serious in nature. Regard being had to general and omnibus nature of allegation and the submissions, as made by the learned counsel for the petitioners, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in Madhuban P. S. Case No.78 of 2016, G. R. No.
Patna High Court Cr.Misc. No.5544 of 2018 (2) dt.02-02-2018 3/3 event of their arrest or surrender before the court below within six weeks from today.
