JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 379, 420, 467, 468, 471 and 504 of the Indian Penal Code.
It is alleged that accused persons in conspiracy with the Revenue Authority, during pendency of 144 Cr. P.C proceeding, changed in the revenue record from Khesra No. 1191 to Khesra No. 1192 in order to grab the land of the informant. It is submitted by learned counsel for the petitioners that with regard to land in question, 144 Cr. P.C. proceeding was initiated and the land resolution dispute case was decided in favour of the petitioner Manoj Yadav and thereafter the present
Patna High Court Cr.Misc. No.53367 of 2015 (2) dt.24-11-2015 2/2 case has been lodged. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation in the background of civil nature of dispute, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Bihra P.S. Case No. 114 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
