The petitioner apprehends his arrest in Mahnar P.S. Case No.110 of 2018 registered under Section 304(B)/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is the husband of the deceased but after institution of the F.I.R., the informant himself made statement before the police that on account of misinformation, he lodged the case. The informant also filed petition before the Court but it appears from perusal of the F.I.R. itself that the petitioner is the husband and it was he who burnt his wife after sprinkling kerosene oil and the wife of the petitioner died due to burn injury within one year of her marriage. It appears that petitioner made attempt to

Patna High Court CR. MISC. No.24575 of 2019(2) dt.16-04-2019 2/2 tamper with the evidence by getting the petition filed. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
