The petitioner assailed orders by which he has been removed from the post of constable and an FIR was registered against him on the ground that he had obtained service in the police department on the basis of forged certificates, showing his date of birth as 09.04.1978 instead of actual date of birth 09.04.1980.

The enquiry was conducted and the petitioner was given chance to submit his defence, whereafter considering that forged documents having been submitted as well as the date of

Patna High Court CWJC No.20753 of 2013(2) dt.24-01-2023 2/2 birth was 09.04.1980 and not 09.04.1978, action has been taken. The memorial appeal was also rejected on 02.08.2013. Keeping in view, the nature of service which require highest level of discipline and maintainability is required to be maintained, the order passed by the respondents is found to be within the framework of law and does not warrant any interference.

This writ petition is devoid of merits and accordingly dismissed.
