1. The petitioner prays for compassionate appointment on the ground of death of his father who expired while in service. It is stated that the petitioner had applied for the post as his father expired on 22.03.2005 in an accident while working as clerk at Primary Health Centre Belaganj. His application form was forwarded. However, an objection has been raised by the Respondents on the ground that his mother is in service.

2. The petitioner has contended that his mother is not residing with the petitioner because his mother was separated from his father much earlier. However, no document in this regard of degree of separation or divorce has been placed before

Patna High Court CWJC No.23811 of 2012(2) dt.02-01-2023 2/2 this Court. The mere statement of the petitioner that his mother was separately residing from his father, would not be a sufficient ground to ignore the serving parent of the petitioner.

3. The writ petition is mis-concieved and is accordingly dismissed.
