Petitioners apprehend their arrest in connection with Katihar Muffasil P.S. Case No. 132 of 2017 registered under Sections- 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code and 27 of the Arms Act pending in the Court of C.J.M., Katihar.

Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case with an ulterior motive and previous enmity. Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioners are named in the

Patna High Court Cr.Misc. No.40813 of 2017 (2) dt.30-08-2017 2/2 F.I.R. with specific allegation of assault. The witnesses have also supported the prosecution case.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of anticipatory bail to the petitioners. Their prayer for anticipatory bail is, therefore, rejected. (Arvind Srivastava, J) Shailendra/- U T
