The petitioner is apprehending his arrest in connection with Mejarganj P.S.Cae No.126 of 2014 registered for offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of assault by Farsa on the head of the informant. Submission of the learned counsel for the petitioner is that he has not been sent up for trial however, under Section 319 of Cr.P.C summon has been issued to the petitioner and the injuries are simple in nature.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.23208 of 2018 (2) dt.19-04-2018 2/2 circumstances, as stated above, the petitioner is directed to surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below in view of nature of the injury and he will dispose of the application on the same day, if possible.

With the aforesaid observation, this application is disposed of.
