Petitioner seeks regular bail in connection with Saraiya P.S. Case No. 404 of 2018 registered for the offence under sections 302, 376, 201, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that similarly situated co-accused has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 6899 of 2019 on 23.04.2019, as contained in Annexure-P2 to the bail application. Petitioner is in custody since 09.09.2019.
Patna High Court CR. MISC. No.22870 of 2020(2) dt.11-09-2020 2/2 Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending (A.C.J.M.-I, West Muzaffarpur) in connection with Saraiya P.S. Case No. 404 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. .
