This application, for grant of anticipatory bail, arises out of Complaint Case No. 1274 of 2015, disclosing offences under Sections 304-B and 201/34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that the petitioners happens to be father-in-law, mother-in-law and brothers-in-law of the deceased. Earlier a complaint petition was filed, which was subsequently converted into a police case and the police after investigation found the allegations to be untrue thereafter, a protest petition was filed and the cognizance has been taken. It has further been submitted that there is no specific

Patna High Court Cr.Misc. No.49578 of 2016 (2) dt.14-12-2016 2/2 allegation against these petitioners and they all have a clean antecedent.

Having heard both sides and considering the facts and circumstances of the case and the submissions advanced, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabhua, in connection with Complaint Case No. 1274 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
